The materials will be the responsibility of the client; does not included materials like: tile, grout, vanity light, sink toilet, mirror, doors and glass door.

This proposal includes materials to install Waterproofing Schluter System , Ditra, 1 Niche, 2by4, Drywall-plaster for the cabin and floor shower,  any other material not specified here it will be paid by the client.

Any service requested that is not specified has an extra payment.

Terms

METHOD OF PAYMENTS.

Down    payment 40% $3,1600.00 at the day the contract gets signed.

Second Payment 30% $2,700.00 upon completion plumbing work.

Final     Payment 30% $2,700.00 upon completion of the all contract works.

CONTRACT TERMS.

Payments must be made by check or cash. **payment must be made within 3 days of project completion, or late fees will be applied. If payment is not made within 30 days of project completion, Alex construction will refer to your account for debt collection. An interest rate of 1.5% a month, or 18% annually will be charged to all past due accounts. A $35,00 fee will apply to any return check. Customers shall be and are responsible for all costs of collection, including reasonable attorney’s fees, arising from any breach of agreement or failure to pay any amount due and owing. This specifically includes, but not limited to, any losses by Alex Construction related to equipment or overhead.

WARRANTY / LIMITATIONS OF LIABILITY

The workman warranty period is 2 years from project completion. Alex Construction warranty covers any defective workmanship performed by the company, as well as any additional warranties imposed by law manufacturer’s warranties for all goods/products used also apply customers exclusive remedy and Alex Construction sole liability under this warranty shall be for Alex Construction to correct any material failure of performance, if such failure is reported to Alex Construction within the warranty period. customers claim for damages shall be limited to the amounts paid for services rendered hereunder only, and shall not include any incidental or consequential damages.

CHANGE ORDERS

Any changes to the scope of work as described above will only be binding and accepted if agreed upon in writing. Payment for a change order is subject to the same terms listed in paragraph 4 of this agreement, except that payment for change order items are not subject to the 50% down payment if the project has already commenced.
In the event of a change order, the parties agree the change order shall become part of this agreement, and subject to all the terms and conditions listed herein.

LEGAL NOTICES

If any portion of provision of this agreement is to any extent declared illegal or unenforceable by a court of competent jurisdiction, then the remainder of this agreement , will not be affected thereby, and each portion and provision of this agreement shall be valid and enforceable to the fullest extent permitted by the law.
This is a Massachusetts contract and shall be trusted and governed in all respects by the laws of the commonwealth of Massachusetts. I hereby accept this scope of work terms and conditions, including payment, and agree that there are no other terms which make up this agreement either expressed or implied.
